Objectives: To analyse and compare the surveys on German doctors and judges on end of life decision making regarding their attitudes on the advance directive and on the dying process.Design: The respondents were to indicate their agreement or disagreement to eight statements on the advance directive and to specify their personal view on the beginning of the dying process.Participants: 727 doctors in three federal states and 469 judges dealing with guardianship matters all over Germany.Main measurements: Comparisons of means, analyses of (...) variance, pivot tables and factor analyses .Results: Three attitude groups on advance directive were disclosed by the analysis: the decision model, which emphasises the binding character of a situational advance directive; the deliberation model, which puts more emphasis on the communicative aspect; and the delegation model, which regards the advance directive as a legal instrument. The answers regarding the beginning of the dying process were broadly distributed, but no marked difference was observed between the responding professions. The dying process was assumed by most participants to begin with a life expectancy of only a few days.Conclusions: A high degree of valuation for advance directive was seen in both German doctors and judges; most agreed to the binding character of the situational directive. Regarding the different individual concepts of the dying process, a cross-professional discourse on the contents of this term seems to be overdue. (shrink)

In the field of socio-legal studies or law and society scholarship, it is rare to find empirically rich and conceptually sophisticated understandings of actual legal practice. This book, in contrast, connects the conceptual and the empirical, the abstract and the concrete, and in doing so shows the law to be an irreducibly social, material and temporal practice. Drawing on cutting-edge work in the social study of knowledge, it grapples with conceptual and methodological questions central to the field: how and where (...) judgment empirically takes place; how and where facts are made; and how researchers might study these local and concrete ways of judging and knowing. ZusammenfassungIm Rahmen des Modellvorhabens „Patienten als Partner—Tumorpatienten und ihr Mitwirken bei medizinischen Entscheidungen“ wurden zwischen März 2002 und August 2003 272 palliativ behandelte Tumorpatienten nach ihrer Einstellung zur Patientenverfügung und zur gewünschten Beteiligung an medizinischen Entscheidungen befragt. Von den Befragten kannten 30% Patientenverfügungen nicht, darunter signifikant mehr Befragte mit formal niedrigerem Bildungsabschluss. Es hatten bereits 11% eine Patientenverfügung abgeschlossen, 22% wollten wahrscheinlich eine abschließen, und 30% wollten keine abschließen. Es fand sich ein statistisch signifikanter Zusammenhang zwischen dem Abschluss einer Patientenverfügung (...) und dem Wunsch nach mehr eigener Entscheidungsverantwortung. Die Einstellung zur Patientenverfügung und der Wunsch nach partizipativer Entscheidungsfindung stehen in keinem statistisch signifikanten Zusammenhang. Patienten mit schriftlichen Vorausverfügungen haben einen erhöhten Kommunikations- und Rückkopplungsbedarf, auf den Ärzte sensibel eingehen sollten. Bei der Information über Patientenverfügungen sollten Menschen mit niedrigerem Bildungsstand mehr als bisher berücksichtigt werden. (shrink)

Konzeptionen des Neuen und der Erneuerung begleiten die menschlichen Kulturen und Zeiten. Der Beitrag nimmt konkrete Lebens- und Textwelten der biblischen Überlieferung des Judentums und des Christentums in den Blick, wie sie in den Traditionen der Hebräischen Bibel/des Alten Testaments zu finden sind. Zum einen zeigt sich dabei eine pragmatische und auf die Förderung der Lebensverhältnisse von Gemeinschaft und Mensch orientierte Rede vom Neuen. Zum anderen gibt es ein Wissen um Neues und Vollkommenes als Wissen um einen Schöpfer, der Vollkommenes (...) und Schönes schafft (Kohelet) sowie als Gegenbild zu Defizientem und Bösem, mit dem Bildung, Gesellschaft und Religion ringen. Die alttestamentliche Gottesrede kennt in ihren unterschiedlichen Spielarten ein wechselseitiges Verweisverhältnis zwischen Gott und Mensch. Darin begegnet die Perfektion Gottes als Grenzbestimmung und das Imperfekte als Modus der Darstellung Gottes. In der Konsequenz lassen sich weder der Mensch noch Gott in den Vorstellungen des Perfekten oder des Imperfekten allein angemessen erfassen.

What is empiricism? There can be no authoritative answer to any such question. A historian of philosophy can at best try to call what is common to philosophers who either identified themselves, or have traditionally been identified, as empiricists. But what has set those philosophers apart from others, and especially from those whom they criticized, may not be captured in common views or doctrines. The historian may, in trying to fix the label, rely tacitly on a view of what philosophical (...) positions are and how they are to be identified. Finally, it is typical of philosophers who decide to range themselves under some pre-existing banner ("empiricism", "pragmatism", "phenomenology") to change the very philosophy they take on, as much as did their historical heroes in their day. I will here try to give a sustained argument about what empiricism cannot be, and then enter upon a tentative exploration of what it should be (taken to be). (shrink)

There exist at present many conceptions of postmodern(ism). But there is a certain number of differences between the conceptions of postmodernism in the arts and the conceptions of postmodernism in various spheres of social activities. In arts, people pay much attention to the significant attributes of the concept, but in spheres of social life, the term is often used as a criterion to marking time in the periodization of history. That is, while in arts the significant attributes will make the (...) criteria to define the postmodernism, in social life the concept of postmodern(ism) exists a priori and does not depend on social characteristics. That is for many people, the postmodern era is simply taken for granted as the period after the Second World War. At the same time, we have to recognize that thearbitrary and easy use of this term in the social life has spread contagiously to the artistic field. Many people simply attribute the label of “postmodern” to all creations outside the traditional realism in the second half of the 20th century, only because in their opinion, those creations appeared in the age that they called “postmodern era” for granted. Thus, in this way, “postmodern” may have too many different and indefinite meanings, but just thereby, it has also no meaning at all. This situation has brought ambiguity to defining the status of contemporary arts. I can only state that, in the field of arts, despite different conceptions of “postmodern(ism)” among many persons, we may conclude that it is more exactly to use this concept only to designate the summit or the “paroxysm” of modernism; and it still bears a temporal character to designating the second half of the 20th century. With the meaning of “paroxysm”, the term of “postmodern” can be entirely replaced with the term “modern”, or more precisely, with the term “meta-modern” or “ultra-modern”. Besides, we should be vigilant against the abuse of the concept “postmodern” which is being used fairly popularly in the current socio-political life, and most of these cases of abuse only want to make impressions of the “ultra-new” (or “ultra-modern”) character of the events. Just because of this abuse, the concept “postmodern” runs the risk of becoming platitudinous, leads to becoming meaningless because of bearing too many different and indefinite meanings, and thereby loses its effectiveness and usability. For my own part, I think that we should use the concept “postmodern(ism)” only for architecture and painting. As for other fields, especially for literature, we should not use it, and instead, we shall make use of the concept “modern(ism)” or at the most, we shall use the concept “ultra- or meta-modern(ism)” which will be precise and very appropriate. It is not necessary that, whenever to make impressions of the newest, one should have to recourse to the term “postmodern(ism)”, and then to be at a loss in making efforts to find the characteristics in order to ascribe them to the term to demonstrate its legitimate existence, but in fact, these characteristics are not of its own. Les décisions politiques sur les risques environnementaux complexes font fréquemment intervenir des éléments scientifiques contestés. Il n’y a généralement pas de « faits » qui conduisent à une politique correcte unique. Les éléments de preuve qui sont intégrés dans les avis scientifiques destinés à une décision politique nécessitent une évaluation de leur qualité. En 2003, l’Agence néerlandaise d’évaluation environnementale a adopté une méthode standardisée, désignée sous le nom de « guide », dans le cadre de laquelle les principaux aspects de (...) la production et de l’utilisation des connaissances sont présentés grâce à une liste de contrôle visant à l’évaluation et à la communication des incertitudes. Dans cet article, nous présentons des résultats de l’application de ce guide à la controverse sur les risques des particules en suspension. La délibération active sur l’incertitude dans un contexte d’expertise entraîne un processus d’apprentissage commun entre les experts et les décideurs politiques, ce qui conduit à une meilleure prise de conscience du phénomène d’incertitude et de ses implications politiques.Policy decisions on complex environmental risks often involve disputed science. Typically, there are no “ facts” to support a single unequivocally correct policy. The evidence provided in scientific studies for policy-making decisions requires high-quality assessment. In 2003, the Netherlands Environmental Assessment Agency adopted a standardized method, referred to as “guidelines”, whereby key quality aspects of knowledge production and use are presented in the form of a checklist for uncertainty assessments and communication. In this article, we present the outcomes of applying the guidelines in controversies on the risks of ambient particulate matter. In the policy–advisory context, active deliberation on uncertainty produces a common learning process for advisors and policy makers, which leads to a deeper understanding and increased awareness of the phenomenon of uncertainty and its policy implications. ABSTRACT In ‘The philosophical basis of intuitionistic logic’, Michael Dummett discusses two routes towards accepting intuitionistic rather than classical logic in number theory, one meaning-theoretical and the other ontological. He concludes that the former route is open, but the latter is closed. I reconstruct Dummett's argument against the ontological route and argue that it fails. Call a procedure ‘investigative’ if that in virtue of which a true proposition stating its outcome is true exists prior to the execution of that procedure; (...) and ‘generative’ if the existence of that in virtue of which a true proposition stating its outcome is true is brought about by the execution of that procedure. The problem with Dummett's argument then is that a particular step in it, while correct for investigative procedures, is not correct for generative ones. In Beyond the Frege Boundary [6], Keenan established their importance for natural language semantics, by showing that natural language has many examples of irreducible type n functions, where he called a function of type n reducible if it can be represented as a composition of functions of type 1 . We will give a normal form theorem for functions of type n , and use this to show that natural language (...) has many examples of irreducible type n functions in a much stronger sense, where we take a function to be reducible if it can be represented as a composition of functions of lower types.
